Terms of Service

These Terms of Service ("Terms") govern your access to and use of services provided by DriteStudio, a brand operated by Craft Intertech (Thailand) Co., Ltd. ("Company", "we", "us"). By creating an account, purchasing, or otherwise using our services, you agree to be bound by these Terms together with our Privacy Policy, Acceptable Use Policy (AUP), and Refund Policy, each of which is incorporated herein by reference. Please read them carefully.
1. Acceptance of Terms
By creating an account, ordering a service, or using any part of our platform, you confirm that you have read, understood, and agree to be legally bound by these Terms, the Privacy Policy, the AUP, and the Refund Policy. If you are entering into these Terms on behalf of an organization, you represent that you have authority to bind that organization. If you do not agree, do not use our services.
2. Definitions
For the purposes of these Terms, the following definitions apply:
- "Company", "we", "us", "our" — DriteStudio, a brand operated by Craft Intertech (Thailand) Co., Ltd.
- "Customer", "you", "your" — the individual or legal entity that registers for, purchases, or uses our services
- "Services" — VPS, VPS Forex, Web Hosting, Dedicated Server, Game Server Hosting, Colocation, Security services, domain registration, and any related offerings
- "Account" — the credentialed identity through which you access and manage Services
- "Customer Content" — any data, software, configuration, files, or material that you upload, install, store, or transmit through the Services
- "AUP" — the Acceptable Use Policy published at /acceptable-use
- "Refund Policy" — the Refund Policy published at /refund
- "Privacy Policy" — the Privacy Policy published at /privacy
3. Description of Services
We provide digital infrastructure and related services. The specifications, plan tiers, fair-use limits, and SLAs applicable to each Service are published on the order page for that Service and form part of the agreement between you and us. Available Services include but are not limited to:
- Virtual Private Servers (VPS) and VPS Forex (low-latency variants)
- Dedicated Servers (single-tenant hardware)
- Web Hosting with Plesk control panel and free SSL
- Game Server Hosting
- Colocation in our datacenter facilities
- Security services (WAF, DDoS protection, SOC monitoring)
- Domain registration (subject to ICANN and registry rules)
- Related technical support
4. Account Registration and Responsibility
To use most Services you must register for an Account. You agree to:
- Provide accurate, current, and complete information during registration and keep it up to date
- Maintain the confidentiality of your Account credentials, including passwords, two-factor codes, recovery codes, and passkeys
- Be solely responsible for all activity occurring under your Account, whether authorized or not
- Notify us immediately upon discovering unauthorized access or any suspected security compromise
- Be at least 20 years of age (Thailand's age of majority for contractual capacity) or have verifiable parental or guardian consent
- Not transfer your Account to another person without our prior written approval
- Acknowledge that we reserve the right to refuse an order, suspend provisioning, or request additional verification if we identify risk of fraud, AUP violations, inaccurate account information, sanctioned entities, identity mismatch, or usage that may impact our infrastructure, other users, or third parties
5. Acceptable Use
Your use of the Services is governed by our Acceptable Use Policy (AUP), available at /acceptable-use, which forms an integral part of these Terms. The AUP describes prohibited activities in detail, including network abuse, packet manipulation to bypass mobile-carrier billing or zero-rated entitlements (e.g., V2Ray, Xray, Shadowsocks-style tunneling configured to obtain free internet), prohibited content, cryptocurrency mining restrictions, and fair-use resource limits. Violations of the AUP may result in immediate suspension or termination of the affected Service or Account without refund and, where applicable, referral to law enforcement.
6. Fees, Billing and Payment
Fees and payment terms applicable to all Services:
- Service fees are quoted in Thai Baht (THB) unless otherwise specified at the time of order
- Prices are inclusive or exclusive of Thai Value Added Tax (VAT) as indicated at checkout; you are responsible for any taxes, withholding, or fees imposed by jurisdictions outside Thailand
- Invoices are due upon issuance. Recurring services automatically renew at the end of each billing cycle unless cancelled before the renewal date
- Accepted payment methods are listed at checkout and may be added or removed from time to time
- Late or unsuccessful payments may result in service suspension. Restoration is at our discretion and may incur a reactivation fee
- We may change pricing for future renewals with at least 30 days' prior notice; the price for your current billing cycle is not affected
- Promotional or introductory pricing applies only for the period explicitly stated; standard pricing applies thereafter
7. Refunds
Refunds are governed by our Refund Policy, available at /refund, which forms an integral part of these Terms. Our default position is that service fees are non-refundable. Refunds are limited to narrow, infrastructure-side failure scenarios as described in the Refund Policy. Issues caused by third-party software installed or configured by the customer (operating systems beyond our default images, control panels, applications, scripts, plugins) are not refundable.
8. Service Level Agreement (SLA)
We target 99.9% network uptime for production Services, measured monthly at the network edge of our datacenter. If unplanned downtime exceeds the SLA threshold, you may be entitled to service credits as specified in the SLA for the affected Service. Service credits are issued as account credit, are the sole and exclusive remedy for downtime claims, and are not redeemable for cash. Excluded from SLA calculations are: scheduled maintenance announced in advance, force majeure events, customer-caused issues, third-party software failures inside Customer services, and Services suspended for AUP, Terms, or payment violations.
9. Suspension and Termination
We may suspend or terminate your Account or any Service, with or without prior notice, in the following circumstances:
- Breach of these Terms, the AUP, the Refund Policy, the Privacy Policy, or any other applicable policy
- Failure to pay any invoice when due
- Activity that endangers users, our infrastructure, or third parties, including AUP violations and abuse
- Court order, regulatory directive, or law enforcement request
- Suspected fraud, abuse, identity falsification, or compromised account credentials
- Chronic non-compliance with our policies, after written notice and an opportunity to remediate
- You may terminate your Account at any time by following the cancellation procedure in your client area. Termination does not relieve you of obligations to pay outstanding amounts. Upon termination, Customer Content may be deleted in accordance with our published retention schedule
10. Backups, Data Loss and Self-Managed Services
Unless explicitly identified as a Managed Service, our infrastructure offerings (including VPS, VPS Forex, Dedicated Server, Game Server, Colocation, and similar) are self-managed: you are responsible for the operating system, applications, security configuration, software updates, and the data you store within the Service. We may provide guidance or best-effort assistance, but this does not constitute an obligation to operate, administer, or maintain your environment on your behalf. Unless a managed backup service is explicitly included in your service plan, you are solely responsible for maintaining your own backups of Customer Content stored on the Services. Snapshot or backup features that we may make available are a convenience and are not a substitute for your own independent, off-site backups. To the maximum extent permitted by Thai law, we disclaim liability for data loss arising from hardware failure, software bugs, accidental deletion, malicious activity, security incidents, force majeure, or service termination. After service termination, Customer Content may be irrecoverably deleted in accordance with our retention schedule.
11. Intellectual Property
Intellectual property rights under these Terms are allocated as follows:
- DriteStudio Materials — all software, designs, documentation, source code, trademarks, logos, and content on our website, control panels, and APIs are owned by us or our licensors. We grant you a limited, non-exclusive, non-transferable, revocable license to use them solely to access and use the Services in accordance with these Terms
- Customer Content — you retain all rights to Customer Content. You grant us a limited, worldwide, royalty-free license to host, store, transmit, back up, and process Customer Content solely as necessary to operate the Services for you
- Feedback — any feedback, suggestions, or ideas you provide to us about the Services may be used by us without restriction or compensation
- Trademark use — you may not use our names, logos, trademarks, or trade dress without our prior written permission, except as required for accurate factual reference
- Network resources — IP addresses, subnets, reverse DNS, routing policy, ASN allocations, and other network resources we assign are provided for use with the Services only and are not the property of the customer. We may change, reclaim, or reassign network resources when reasonably necessary for technical, security, legal-compliance, or network-management reasons, with reasonable notice where practicable
12. Disclaimers, Warranties and Limitation of Liability
Services are provided on an "AS IS" and "AS AVAILABLE" basis. To the maximum extent permitted by Thai law, we disclaim all warranties of any kind, whether express or implied, including without limitation warranties of merchantability, fitness for a particular purpose, non-infringement, and uninterrupted or error-free operation. To the maximum extent permitted by law, in no event shall DriteStudio, Craft Intertech (Thailand) Co., Ltd., or our affiliates, officers, employees, agents, or licensors be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages — including without limitation loss of profits, revenue, data, goodwill, or business interruption — arising out of or related to your use of the Services, even if advised of the possibility of such damages. Our aggregate liability for any and all claims relating to the Services is limited to the amount you actually paid us for the affected Service in the twelve (12) months preceding the event giving rise to the claim. These limitations apply regardless of the legal theory on which the claim is based and survive termination of these Terms.
13. General Provisions and Contact
13.1 Indemnification — You agree to indemnify, defend, and hold harmless DriteStudio, Craft Intertech (Thailand) Co., Ltd., and our affiliates, officers, employees, and agents from and against any third-party claims, damages, liabilities, costs, and expenses (including reasonable legal fees) arising from your breach of these Terms, your Customer Content, or your violation of any law or third-party right. 13.2 Force Majeure — Neither party is liable for any delay or failure to perform caused by events beyond reasonable control, including natural disaster, war, terrorism, civil unrest, government action, upstream network outage, undersea cable failure, pandemic, or power failure. 13.3 Governing Law and Dispute Resolution — These Terms are governed by and construed in accordance with the laws of the Kingdom of Thailand, without regard to conflict-of-law principles. The parties will first attempt in good faith to resolve disputes through direct negotiation. Disputes that cannot be resolved within 30 days will be submitted to the exclusive jurisdiction of the courts of Thailand, with primary venue in Samut Sakhon Province. 13.4 Severability — If any provision of these Terms is held invalid or unenforceable, the remaining provisions remain in full force and effect. 13.5 Entire Agreement and Assignment — These Terms, together with the Privacy Policy, AUP, and Refund Policy, constitute the entire agreement between you and us regarding the Services and supersede any prior agreement. You may not assign these Terms without our prior written consent; we may assign these Terms to an affiliate or to a successor in interest. 13.6 Notices and Changes — Notices to us should be sent to the address below; notices to you may be sent by email to your registered email address or by in-platform notification. We may update these Terms from time to time. Material changes will be communicated by email or via the website at least 30 days before they take effect, except where shorter notice is required by law. Continued use of the Services after the effective date constitutes acceptance. 13.7 Language and Interpretation — These Terms are published in Thai and translated into other languages for convenience. In the event of any inconsistency between the Thai version and a translation, the Thai version shall prevail, unless the Company explicitly states otherwise for a specific case.
